Miamisburg Man Arrested in Illinois on 2020 Montgomery County WarrantThe Old Montgomery County Courthouse in downtown Dayton

A Miamisburg man who had been wanted on a Montgomery County warrant for six years has been arrested in Illinois and agreed to be returned to Ohio to face charges involving a child under the age of 13, according to court records in both states.

Jason David Riley, 27, was arrested in Ford County, Illinois, on the Ohio warrant. Appearing in court there on Friday, Riley waived extradition, clearing the way for him to be transported back to Ohio to answer the Montgomery County case.

Montgomery County court records show the case against Riley was opened in 2020, and that he faces five counts of gross sexual imposition, the Ohio offense covering sexual contact imposed by force or with victims who cannot legally consent. The charges specifically allege that the victim in the case was under the age of 13.

Riley was indicted in 2020, but court records show the case then sat dormant for years, with no developments until last year, when authorities expanded the geographic search area for his outstanding warrant. His last known address was in Miamisburg, the Montgomery County suburb south of Dayton.

That wider search is what eventually caught up with him. After six years on the run, Riley was located and taken into custody in Ford County, in east-central Illinois, and the extradition waiver he signed Friday removes the main legal step that could have delayed his return. Without a waiver, a contested extradition can hold a defendant in the arresting state for weeks while governors’ warrants are processed; by agreeing to return voluntarily, Riley shortened that process considerably.

Riley remains presumed innocent of the charges unless and until he is convicted. No Montgomery County court dates had been announced as of Monday, and the case will proceed in the county where the indictment was filed once he is back in Ohio custody.

The arrest closes one of the older open warrant cases on Montgomery County’s books from 2020, a year in which the indictment was returned but the defendant could not be found to face it. Further hearings, including an arraignment on the five counts, are expected after his transfer is complete.
